"Diseconomies Inherent in Western Water Laws: A California Case Study" (read before the Western Agricultural Economics Research Council, Tucson, Arizona, January 23, 1961; published in Economic Analysis of Multiple Use, Report No. 9 in the Water and Range Resources series, Western Agricultural Economics Research Council, pp. 55–82) is an early, intensely empirical case study — written while Gaffney was on the University of Missouri faculty, nine months before "The Unwieldy Time-Dimension of Space" (October 1961), making it the earliest-dated professional/academic paper so far identified in the wiki's Gaffney corpus after the 1957 timber monograph and the 1958 Yearbook of Agriculture essay (see priority note below and the cross-reference on people/mason-gaffney). "The Taxable Surplus in Water Resources" (Contemporary Policy Issues 10, October 1992, pp. 74–82, Western Economic Association International — a revised version of a paper delivered at the WEAI's 66th annual conference, Seattle, July 1, 1991) is Gaffney's mature synthesis, written thirty-one years later while he was at UC Riverside: a systematic proposal to tax water withdrawals, structured as a rebuttal of six named fallacies obstructing the idea. Between them, the two essays cover the full arc: an empirical diagnosis of how legal doctrine (not scarcity or technology) misallocates a rent-bearing resource, and a mature policy proposal for how to fix it.

Part I: Diseconomies Inherent in Western Water Laws (1961)

The Kaweah River as a Natural Experiment

Gaffney studies the Kaweah River distributary system in the southeastern San Joaquin Valley (largely Tulare County, California) — over twenty separate water-user organizations sharing water from a single alluvial-cone system, with unusually complete daily-diversion records (California Division of Water Resources Bulletins 49, 49A, 49B, 1920–55) and low transportation and water-quality complications, making it, in his framing, close to a controlled test of whether water law allocates a shared resource efficiently.[1]

Wide Dispersion in the Marginal Value of Water

Gaffney assembles several independent lines of evidence to show the marginal productivity of water varies enormously between adjacent, physically connected users on the same system — a direct sign of misallocation, since an efficient market would equalize marginal returns:

  • Conservation effort as a revealed-value proxy. The Lindsay-Strathmore Irrigation District (citrus, in the "thermal zone") pumped water over 200 feet, distributed it under pressure through steel pipe for sprinklers, and paid $8.14 per delivered acre-foot in tolls and taxes (1949) — one of the most elaborate conservation systems of any California irrigation district. The Tulare Irrigation District, a few miles away in the delta, lost roughly 50% of diverted water through a long unlined ditch, with an "irrigation efficiency" independently estimated at .39 by state engineers — Gaffney is explicit this reflects rational behavior given the legal framework, not incompetence: "It is rather that framework itself which is under examination here."[1]
  • Value of output per acre-foot. Navel-orange land in the thermal zone grossed roughly $300 per acre-foot of water versus roughly $30 for the Consolidated Peoples' Ditch Company's delta service area (barley, pasture) — a better than tenfold gap on adjacent, physically shiftable water. Net of variable costs, marginal water value ran $200–$500/acre-foot for navels versus roughly $10–$40 for cotton, alfalfa, barley, and pasture.[1]
  • Land-value response to water access. Reliable water access in the thermal citrus zone added roughly $500–$800 an acre to raw land otherwise worth $50–$100 (dry, grazing value) — a direct land-value capitalization of water rent, the same mechanism the wiki documents for land access and transit access elsewhere, here applied to water specifically.[1]
  • A physically costless transfer blocked by law alone. Lindsay-Strathmore had bought shares in the water-rich Consolidated Peoples' Ditch Company and an easement to shift water to itself at zero physical transfer cost in 1928 — and was stopped by a court injunction (Consolidated Peoples' Ditch Co. v. Foothill Ditch Co., 1928).[1] Gaffney's point: the barrier was only legal, not physical or economic.

Water Rights Are Assigned by Doctrine, Not Productivity

Gaffney's structural diagnosis is that none of California's three water-right doctrines allocates water toward its highest-value use:

  • Riparian rights, tied to land fronting a natural channel, happened to attach the Kaweah's surface water to lands with the shallowest pump lifts and least need for it — "riparian rights attach surface waters to the lands that need them least."[1]
  • Appropriative rights ("first in time, first in right") reward early diversion regardless of soil quality: fast-developing, low-capital uses (hay, grain) staked early claims on good water, while high-value, high-capital uses (citrus orchards) that took longer to develop — and ultimately generated far higher marginal productivity — arrived too late to get it. Worse, the "doctrine of relation" (priority dated to first claim, not first use) rewards premature, inflated claims: "a cost to society — withdrawing water — is made a revenue to the appropriator," which Gaffney calls perverse once water is scarce rather than superabundant.
  • Correlative rights (percolating groundwater) similarly tie use to overlying land rather than value, and on the Kaweah the courts had denied permission to export groundwater from low- to high-marginal-productivity parcels even where the law in principle allowed "surplus" transfers.

[EDITORIAL: added 2026-07-18] A later, more systematic Gaffney paper — "Economic Aspects of Water Resource Policy" (American Journal of Economics and Sociology 28(2), April 1969, pp. 131–44; a paper delivered at a Pennsylvania State University colloquium, June 4, 1968; hereafter H8) — scores riparian and appropriative doctrine against the same nine criteria (initial allocation, motive to develop, constraint on uneconomic use, rationing under scarcity, transferability, pooling for cooperative action, aquifer management, containment of service area, and distributive equity) and finds both wanting on nearly every one, generalizing H3's single-river Kaweah diagnosis into a structural argument: riparian rights fail because they attach water to land "regardless of productivity" and play a "dog-in-the-manger" role (the riparian can enjoin others' use of water he neither needs nor develops himself); appropriative rights fail because "first in time, first in right" converts a social cost (withdrawal) into a private claim on all of a stream's future rents, and because seniority rationing under scarcity pools no risk — a single senior appropriator holds a 100%-firm supply while the most junior holds one "so uncertain it is unusable," discarding water's marginal productivity entirely in favor of priority date.[4] H8 also supplies an institutional answer largely absent from H3/H21: California's irrigation districts, which solved the water-supply/farm-scale mismatch (large optimal scale for conveyance versus small optimal scale for the farm unit) through three legally granted powers — taxation, bonding, and forced inclusion of all serviceable land — financed by land-value assessment rather than a per-acre-foot toll, letting districts capture the "pecuniary spillover" (rising land and town values) their own water supply created to retire the bonds that built it. This is the same Wright Act financing mechanism the wiki documents in more historical/political detail on California Irrigation Districts and the Wright Act; H8 supplies Gaffney's own primary-source economic-theory account of why that financing structure works (natural-monopoly economies of scale in conveyance, synchronization of interdependent settler investment, land-tax-financed credit passed to incoming settlers as unappreciated purchase prices) to complement that page's largely secondary-sourced (Scrofani/Georgist-movement) account — a cross-reference rather than a duplicated pass, since this page's subject is rent taxation on withdrawals and that page's is infrastructure finance.[4]

The Dynamic Pattern: Monumental Projects, the Price Umbrella, and Logrolling

Gaffney's second major argument is that water law does not merely freeze a bad initial allocation — it actively biases new development toward large, remote, publicly financed projects over cheap local/marginal adjustment, because courts will not sanction small local reallocations ("Justice… is more to be likened to the near-sighted Mr. Magoo") but will recognize "surplus" once a project reaches far enough afield. He traces a self-reinforcing cycle distinct from anything already on the wiki's Gaffney corpus:

  1. Indivisibility of scale. A remote import must be large to justify canal-capacity economies, to muster the political support needed for water rights and financing, and because service areas typically include dry land that must be served too — producing, on the Kaweah's own case, a Central Valley Project increment several times the entire pre-existing local water supply.
  2. Slow response, long lags. Lindsay-Strathmore's wells first struck toxic boron brine in 1913; Central Valley Project water did not reach them until 1951 — a 38-year lag, during which the area's citrus development was "arrested completely" and competing regions filled the gap.
  3. The price umbrella. Because private land development lags decades behind the public works meant to serve it, land prices in a newly watered area stay artificially high relative to the abundance of raw land the new water supply implies — enticing more competing project starts than markets can ultimately absorb.
  4. Racing for water rights. Any region seeking "surplus" water elsewhere provokes defensive claim-staking by others, incentivizing premature development purely to establish a use history — "the surest means… is to begin developing waters to establish a history of use."
  5. Logrolling. Because monumental interregional transfers exceed local finances, they require state/federal subsidy, which is secured through political bargaining — "there must be something for everyone" — and, to preserve bargaining power, projects are deliberately started before completion of earlier ones, suppressing the visible impact of the first until the next is already underway. Gaffney explicitly likens this mechanism to Indiana's 1836 canal-boom bankruptcy — a distinct historical land/infrastructure-boom-and-bust parallel from the ones already on gaffney-land-booms-destroy-capital, applied here to water infrastructure rather than land credit.

[EDITORIAL: added 2026-07-18] 6. A federal fiscal channel compounding the race. A later Gaffney piece — "The Water Giveaway: A Critique of Federal Water Policy" (in Robert Haveman and Robert Hamrin, eds., The Political Economy of Federal Policy, Harper & Row, 1973; excerpted from Gaffney's 1969 testimony to the Joint Economic Committee's Subcommittee on Economy in Government; hereafter H18) — largely restates the racing/logrolling dynamic above for a congressional audience, but adds one distinct mechanism this page did not yet document: the pre-1986 U.S. income tax let developers expense early operating losses on submarginal water projects against ordinary income while the resulting land-value appreciation was taxed, if at all, at preferential capital-gains rates — "the taxpayer can expense early operating losses which he invests to capture a resource, while he pays no tax on the resource appreciation which he captures." This is a fiscal driver of premature racing, distinct from the legal-doctrine driver above and from the general land-gains-shelter argument the wiki already documents in gaffney-capital-gains-free-enterprise, here applied specifically to water-project racing rather than land holding generally. H18 also names two concrete illustrations not elsewhere on this page: the Colorado River Compact, which Gaffney calls an "economic monstrosity" for dividing water among political states "regardless of demand" rather than productivity — a specific interstate instance of the doctrine-not-productivity diagnosis above — and the Bureau of Reclamation's 1902 "revolving fund," designed to recover and reinvest its capital every ten years but which, by 1969, "has yet to complete the first revolution," a concrete illustration of the slow-payout problem in item 2.[5]

Gaffney documents seven concurrent, mutually reinforcing California subsidy/financing channels feeding this overexpansion circa 1960 (rising value of tax-exempt local-bond status; new state Small Projects Act and Davis-Grunsky Act subsidies; power companies trading free water for Irrigation Districts' property-tax immunity; Army Engineers water projects under flood-control cover; the Bureau of Reclamation's Central Valley Project; the pending $1.75 billion Feather River Project; and a 1961 Interior Department pledge of still more federal funding) — while noting no comparable stimulus existed for private on-farm improvement, so public capacity chronically outran private demand for it, a mirror image of the usual "underinvestment in public goods" framing (he cites Galbraith by name to distinguish his argument from it). He closes by naming 1893 and 1929 as the two prior US land collapses in which excessive water-supply overbuilding for undeveloped land played a leading role, warning that by 1961 the same pattern was recurring a third time.

The Groundwater Treadmill: A Parallel Dynamic for Aquifers

[EDITORIAL: added 2026-07-18] The surface-water dynamic pattern above has a groundwater counterpart Gaffney names "The Great Water Treadmill" in two later pieces — "Whose Water? Ours? Clearing Fallacies about Implementing Common Rights" (paper presented at the public conference "Whose Water?", Institute for Environmental Studies, University of Washington, September 29–30, 1989; revised for publication April 1991; hereafter H20) and, in nearly identical language, the more polished "What Price Water Marketing? California's New Frontier" (American Journal of Economics and Sociology 56(4), October 1997, pp. 475–520; hereafter H22, cited more fully below): subsidized surface-water supply lets landowners overdraft the aquifer beneath their land essentially for free (correlative rights notwithstanding — Gaffney notes pumping can legally be constrained, citing California's coastal saltwater-intrusion limits and the Bunker Hill aquifer restrictions under the Santa Ana River), provoking a state "emergency" rescue project once the overdraft threatens the water table, which resets the subsidy and restarts the cycle — "subsidized water supply followed by overdraft followed by State rescue projects followed by new overdrafts, etc. ad bankruptcy." Both pieces trace the treadmill's origin to a single, named historical case not previously on this page: Los Angeles's 1913 diversion of the Owens Valley's water to the San Fernando Valley, where the served lands "were timely prepurchased by insiders" ahead of annexation — the episode popularly known, after the 1974 film, as the "Chinatown Syndrome."[7][8] [VERIFY: the "Chinatown Syndrome" attribution and the specific insider-prepurchase claim rest on Gaffney's own summary in both pieces; this page does not independently verify the Owens Valley land-purchase history against primary sources.]

A second, more institutional H20 finding: California's water-district governance is frequently disenfranchised from the residents it serves, because voting is typically apportioned by land ownership rather than residency — Gaffney cites the Irvine Water District in Orange County, where of "50,000 registered voters... only four (4) could vote in Water District elections," because the Irvine Company owned essentially all the land titles and merely leased land to residents. He identifies the Wright Act irrigation districts — the same institution documented on California Irrigation Districts and the Wright Act — as "a notable exception," since Wright Act districts extend the vote to all resident registrants rather than to landowners alone, a distinct institutional-design point neither page previously made explicitly.[7]

Part II: The Taxable Surplus in Water Resources (1992)

The Proposal

Gaffney proposes a package of severance, net-proceeds, property, transfer, and gains taxes and/or rental charges on water withdrawals and power drops, paralleling the resource-rent instruments already documented for oil, gas, minerals, and timber elsewhere on the wiki. He frames the tax as a price "charged by the owner of water (the state) for using its property" — the same public-landlord logic as Alaska's ad valorem charge and the mineral-leasing essays, applied to a renewable rather than exhaustible resource — and argues it would simultaneously (i) spur holders of surplus water to sell, (ii) foster conservation, (iii) convert water from a fiscal "sink" to a source of state revenue, (iv) offset concentrated water holdings, and (v) integrate ground- and surface-water economies under one uniform incentive.

Six Fallacies Dispelled

  1. "Water rights are real property." Most state constitutions (Gaffney quotes California Water Code §102: "All water within the State is the property of the people of the State") hold water in public trust; a license is a revocable privilege — analogous to an airline's time slot or a broadcaster's frequency — not a deed. He traces the false equation partly to the "'Forty-niner fallacy": conflating today's large, perpetual appropriative claims with the historically narrow, time-limited ("ten feet square") placer-mining claims that originated the first-in-time doctrine.
  2. "A water charge would be passed on to consumers." Standard tax-shifting doctrine holds for price-takers in competitive markets, but water bears economic rent — it "arises naturally where demand exceeds supply" — so a tax on the rent component is non-shiftable in the same way a land-value tax is.
  3. "Water is worth what it costs to develop." Gaffney contrasts the $20/acre-foot cost of Gage Canal water (Santa Ana River to Riverside) against $240/acre-foot the State charges for imported water at the same city line, and up to roughly $2,000/acre-foot as the true opportunity cost at the system's outer margin — a 100-fold gap between price and social cost he attributes to hidden and cross-subsidies ("the books are cooked").
  4. "Firm up property rights and the market will provide." Gaffney names four specific reasons water markets fail on faith alone: some access is effectively an unalienable birthright best handled as a state revenue duty rather than private sale; water distribution is a natural monopoly requiring centralized, regulated integration (the same argument applied to power, gas, and telecoms); sellers of water are chronically undermotivated because water permits carry no debt and no property tax, so holders face no cash-drain pressure to sell (unlike the recorded, debt-financed real-estate market); and the prior-appropriation doctrine is "the locus classicus of rent-seeking," incentivizing premature, half-used diversion purely to establish a claim to future rents — a distinct instance of the wiki's general rent-seeking mechanism, applied here to water-claim staking rather than to land, farm-subsidy, or resource-leasing rent-seeking. He also critiques 1980s–90s water marketing as typically "win-win-lose" (the public loses) rather than genuinely win-win, since sold permits retroactively validate what he frames as an original private seizure of public domain, subsidies attached.
  5. "Only net consumptive use is a social cost." Using an entropy framing, Gaffney argues that elevation and quality losses are real social costs even where water is technically "returned" to a stream — a point with a formal water-specific content (loss of hydropower/gravity-delivery potential) not analogous to anything already on the wiki's land or mineral rent-taxation pages.
  6. "Common rights must spell tragedy." Gaffney separates the empirical fact of aquifer overdraft from the standard "tragedy of the commons" causal story, arguing that asserting a common right need not mean open, unrestricted access — it can instead mean a state revenue-collection duty (a withdrawal tax being one of five examples he gives, alongside bag limits, effluent charges, timber-harvest regulation, and boating restrictions) — a position that reframes Hardin's tragedy as a property-design failure, not an inherent flaw of common ownership, consistent with the Georgist reading of the commons elsewhere on the wiki.

Designing the Price Mechanism (1977)

[EDITORIAL: added 2026-07-18] H21 argues that withdrawals should be priced but says little about how a price would actually be struck period to period. A short, earlier Gaffney memo — "How a Water Market Might Work" (notes submitted to California's Governor's Commission on Water Rights Law Reform, July 27, 1977; hereafter H19) — sketches a concrete mechanism: for an unstorable stream with unpredictable flow, each user submits a demand schedule (desired withdrawal at each of a range of prices) to a state "watermaster," who cumulates these schedules across users into a single market demand curve and, for whatever flow actually arrives, reads off the market-clearing price and the resulting allocation by interpolation — functioning like a real-time commodity auction (Gaffney compares it to the coffee market) rather than a fixed-tariff utility charge. The watermaster's statutory mandate is to maximize net revenue subject to not withholding supply to raise price — a competitive-market constraint imposed on a legal monopolist — and, for any capital works (storage, conveyance), to maximize discounted cash flow. Gaffney is candid the scheme is imperfect (a single seller facing an organized buyers' association) but frames "maximum feasible improvement," not a textbook perfect market, as the realistic goal — the same standard implicit in H21's and H22's (below) case for withdrawal pricing generally.[6]

Part III: What Price Water Marketing? — Why Voluntary Trading Kept Failing to Clear (1997)

[EDITORIAL: added 2026-07-18] "What Price Water Marketing? California's New Frontier" (American Journal of Economics and Sociology 56(4), October 1997, pp. 475–520; hereafter H22) is Gaffney's most mature and comprehensive single treatment of water marketing specifically — five years after H21 argued for taxing withdrawals, this AJES article diagnoses in detail why, despite two decades of legal reform (Assemblyman Richard Katz's 1982, 1986, and failed 1991 bills removing transfer barriers), California's water market had remained "only as fluid as glue." It substantially supersedes and updates the fallacy-clearing material in the related but less formal 1989/91 conference paper H20 (above) — roughly a third of H20's eighteen numbered fallacies reappear here in expanded, citation-backed form (real property, cost pass-through, development cost, consumptive use, tragedy of the commons, and undermotivated sellers — all already documented on this page from H20/H21) — but adds substantial content genuinely new to this page:

  • The "yield-cutting substitute." Gaffney coins this term for a counterintuitive relationship: because water is such a potent substitute for labor and capital, more water per acre can mean lower yield per acre, as farmers substitute cheap water for costlier inputs rather than intensify. Water's productivity shows up not in higher yields but in lower labor/capital costs that raise net rent despite lower yields — meaning less water per acre, priced correctly, can raise both output per acre and net rent. He illustrates with Fresno, Kings, and Tulare counties, whose population grew 32% in the 1940s under expensive water, then stagnated after two federally subsidized projects (Pine Flat Dam, Friant-Kern Canal) delivered cheap water.
  • Entitlements, not just efficiency, determine outcomes. Gaffney invokes the willingness-to-pay/willingness-to-accept (WTP/WTA) asymmetry from environmental economics to argue that who starts out owning water is not a distributional afterthought Coasian bargaining can costlessly undo — "distribution dominates allocation." His sharpest illustration: survey researchers routinely discard Native American tribes' WTA responses for treaty fishing rights as statistical "outliers" because tribes will not name any sale price, when the correct reading is simply that ownership (in this case, treaty rights with constitutional supremacy) lets a holder be "as unreasonable as you please" — a methodological critique of applying market-clearing logic to holders who were never asked whether to sell in the first place.
  • A modernized, named account of rent-seeking speculation. Updating H21's more abstract "locus classicus of rent-seeking" fallacy, H22 names specific 1990s buyers acquiring stationary water permits from existing holders to commercialize for distant cities — PG&E Properties, Cadiz Land Company (Riverside County), Tenneco (Kern County), and Sid and Lee Bass (oil billionaires who had assembled 45,000 acres in the Imperial Valley) — as a "new, modified, more sophisticated form of rent-seeking, blended with old-fashioned land speculation," concentrating irrigated-land ownership further in the process.
  • "Win-win-lose" made concrete. H21 already flags 1980s–90s water marketing as typically "win-win-lose," but H22 supplies the mechanism and a dated example: a December 1988 U.S. Department of the Interior policy letting recipients of subsidized federal project water resell it and keep the profit, which Gaffney reads through Henry George's line on stolen property — "because I was robbed yesterday... is it any reason... that the robber has acquired a vested right to rob me?" — arguing that each resale manufactures a new "innocent purchaser" who retroactively legitimizes the original underpriced giveaway. His proposed fix is the same withdrawal charge as H21 (a "win-win-win": seller, buyer, and public all gain), not a ban on trading.
  • "Avoided cost" traced to Henry George. Gaffney links the Federal Energy Regulatory Commission's "avoided cost" doctrine (requiring utilities to pay independent power producers the cost of the generation their output displaces) to Henry George's The Science of Political Economy: that the value of a thing is not the past labor that produced it but the future labor its possession avoids — applied here to argue that naturally occurring water at its source is worth its opportunity cost (up to roughly $3,000/acre-foot at the margin for imported Southern California supplies) rather than its historical development cost (as low as $20–30/acre-foot for local sources like the Gage Canal), a sharper, differently sourced restatement of the $20/$240/$2,000 comparison already on this page from H21.
  • A political-economy postscript. H22's closing section documents that mid-century federal officials who tried to pool and price California water flexibly (Bureau of Agricultural Economics staff including Marion Clawson and Walter Goldschmidt) were publicly denounced as "Communist" by landowner lobbies and Senator Sheridan Downey during the McCarthy era, and had their budgets and careers cut for it — offered as one concrete historical answer to why water-institution reform has proven so durably resistant, complementing the "line-up of vested interests" Gaffney catalogues from a landowner's-eye view in H18 (above).[8]

Standing and Limits

Most of this page's sources are Gaffney's own advocacy/analytical work, not third-party peer review of his claims. H3 (1961) is a single-river-system case study (the Kaweah) generalized by assertion ("diseconomies of kinds and degrees that in my observation prevail throughout the Valley and the State") rather than by a multi-system statistical sample; its dollar figures come from a mix of Gaffney's own fieldwork, state engineering bulletins, and other economists' contemporary studies (Adams, Horn, Brewer), and — per the [VERIFY] flag above — its text was recovered via fresh OCR of a poor legacy scan rather than a native text layer, so exact figures should be treated as approximate. H21 (1992) is a synthesis/advocacy essay for a policy-issues journal, not an econometric study of California's water market; its price comparisons ($20 vs. $240 vs. ~$2,000 per acre-foot) rest on Gaffney's own estimate and a single cited Alan Post 1982 state task-force effort, and Gaffney is candid that "no one is able to figure the cost to the penny because the books are cooked" — an admission of estimation uncertainty the wiki preserves rather than smooths over. Neither essay offers a modern (post-1990s) empirical test of water-market performance under the marketing reforms California adopted after 1992; H22 (1997) partially closes that gap for the 1982–1997 window specifically, but no post-1997 update was located this session.

[EDITORIAL: added 2026-07-18] One correction to the "no third-party peer review" characterization: H3's Kaweah case study was publicly challenged in print, and Gaffney's reply survives — "Water Law and Economic Transfers of Water: A Reply" (Journal of Farm Economics 44(2), May 1962, pp. 427–34; hereafter H4), responding to a comment by Dean Frank Trelease of the University of Wyoming College of Law (JFE 43(5), Proceedings issue, December 1961, pp. 1147–52). Trelease argued California law already made appropriative water rights transferable in principle, so Gaffney's blame belonged not on the doctrine but on (a) unaccounted-for spillover benefits from existing uses and (b) licensees' "irrational" attachment to rights they could legally sell. Gaffney's reply — the strongest empirical point in it — states that no appropriative right had transferred on the Kaweah system for decades, and argues the "heirloom attitude" Trelease treats as an exogenous cultural quirk is instead produced by the law's own insecure, conditional framing of water licenses: because holders sense their claims could be challenged or declared surplus, they cling to them, which starves the market of sellers and reinforces the very insecurity that caused the clinging — a feedback loop distinct from, though compatible with, H21's later "undermotivated sellers" argument and H22's parallel treatment (below). Gaffney also proposes, in passing, an early version of a mechanism this page documents more fully elsewhere on the wiki: relying on ad valorem land taxation to automatically capture and redistribute the spillover gains and losses of water-rights transfers, rather than litigating each transfer's externalities case by case. This does not overturn H3's diagnosis — Gaffney's factual rebuttal (zero transfers for decades) went unanswered in print — but it means the wiki's characterization should be that H3's central claim survived a specific, professionally credentialed (a law school dean's) public challenge, not that no such challenge existed.[3]
