"Nonpoint Pollution: Tractable Solutions to Intractable Problems" is a Mason Gaffney essay published in JBA (the printed running header gives only this abbreviation; the full journal title is not stated in the document itself — [VERIFY]), Vol. 18, Nos. 1 and 2 (1988/89), pp. 133–154, while Gaffney was at the University of California, Riverside.[1] An acknowledgement note dates an earlier version to a conference on "Political, Institutional and Fiscal Alternatives to Accelerate Nonpoint Pollution Programs," Milwaukee, December 9, 1987.[1] The masongaffney.org mirror carries two scanned copies of the identical article — F7Nonpoint_Pollution.CV.pdf and F8-NonpointPollution.CV.CV.pdf — from different source scans; F7's OCR text layer is markedly cleaner and is the version read and re-OCR'd for this page (see Provenance below). The essay fills a genuine, previously undeveloped gap in the wiki's coverage of environmental economics: concepts/pigouvian-taxation and concepts/ecological-georgism both make the standard case for charging polluters (Boyce, Daly, the IMF), but neither had carried a Gaffney-specific treatment, still less one that identifies where the standard Pigouvian toolkit breaks down. This essay is that argument, and it resolves the breakdown by routing back to Gaffney's core subject — land — rather than to a better-designed emissions tax.
The Core Argument: Nonpoint Pollution Defeats the Standard Toolkit
Gaffney opens by naming the problem precisely: "nonpoint" pollution — runoff from agriculture, forestry, mining, construction grading, paved surfaces, lawns, septic systems, and urban storm drains — cannot be metered at a single outlet the way a smokestack or an effluent pipe can. Conventional economists, he argues, are "overtrained towards becoming protagonists of the price system" and respond to unmeterable pollution by taxing or regulating a surrogate instead — pesticides, fertilizers, salt — on the theory that this "internalizes the externality" once removed.[1]
He then lists seven specific failure modes of the surrogate-tax approach, worked out from concrete cases (mostly agricultural pesticides and fertilizer):
- No locational sensitivity. A tax on a surrogate applies uniformly, but damage from runoff varies enormously by site; a tax high enough to protect a sensitive watershed reduces yields everywhere, which can perversely pull more marginal acreage into production.
- Revenue capture. Once a surrogate tax raises money, the recipients develop an interest in the revenue that can override the regulatory purpose — Gaffney draws the parallel to 19th-century tariff debates, where revenue interests routinely swamped the stated regulatory aim.
- Leakage. Excise taxes are not leakproof; Gaffney cites his own experience as "a small fruit grower" tempted by illicit herbicide supplies, and a documented pattern of windfall compensation to sellers holding stock of a chemical about to be banned or taxed — which he calls a second "pesticide treadmill," since it rewards developing new harmful products for the payout when they are eventually banned.
- Substitution the tax cannot anticipate, e.g., a nitrogen tax simply pushes farmers toward legumes, a benign switch, but the broader point is that surrogate taxation invites unpredictable substitution effects that a regulator cannot fully model in advance.
- No discrimination among applicators. A uniform surrogate tax "taxes the best for the sins of the worst," over-penalizing careful users and under-penalizing careless ones regardless of the rate chosen.
- Contested regulatory objectivity. Gaffney cites a 1987 Alameda County Superior Court finding that the University of California violated the Hatch Act by favoring agribusiness over family farmers, and quotes entomologist Robert van den Bosch's "pesticide mafia" charge — used to argue that the institutions that would set surrogate tax rates are not neutral referees.
- Second-best. Because the land market is already badly distorted (see next section), the textbook case that "getting one price right" improves welfare does not straightforwardly apply — "when the system is balanced wrong anyway, what is one more distortion?"
This is, in substance, an internal critique of Pigouvian taxation from a sympathetic critic — Gaffney does not reject charging for externalities in principle (he explicitly separates himself from the Coase/Dales tradeable-permit school, declining even to engage with how "offset rights" might apply to nonpoint sources, since he judges permit markets for point sources already captured by "a few corporations" that "grown rich by establishing their respective histories of pollution"). His target is narrower and sharper: nonpoint pollution specifically defeats price-based correction because there is no meterable point at which to apply the price.
The Land-Market Diagnosis
The essay's most distinctive move, and its clearest link to the rest of Gaffney's corpus, is where it goes next. Rather than searching for a better surrogate, Gaffney relocates the problem: "land use decisions are superimposed on a settlement pattern based on massive market failure in land. The phenomena rather imprecisely called 'land speculation' and 'absentee ownership' betray market failure... The result is that the land market is not efficient; land is not properly priced and allocated to begin with. This is the thread I will follow."[1]
He works this thesis through three parallel domains, each showing the same structural pattern — intensive use of good land is discouraged, so activity sprawls onto marginal, erosion-prone land, generating the runoff:
Forestry
Extending the argument already on research/gaffney-forest-taxation (Gaffney's 1980 tax-base survey and 1977 National Forests address), this essay adds a runoff-specific case for why land value taxation of timberland reduces nonpoint pollution rather than merely raising revenue. Good, low, flat growing sites are underharvested and marginal, steep, erosion-prone sites are overharvested, Gaffney argues, because of four tax-code biases: (1) replanting costs must be capitalized rather than expensed, deferring the write-off for decades; (2) most states' yield tax (as opposed to a property tax) removes any carrying cost during the "sterile downtime" between harvest and replanting, so idle cut-over land costs nothing to hold; (3) states that have cut the land-value component of the property tax on timber remove the one incentive that "pricks holders in the most compelling way to restock," while a land-value tax base is automatically zero on genuinely marginal land, so it cannot cause abandonment there; and (4) standing timber's value-added is largely unrecognized as taxable income (capital-asset treatment since 1944) while harvested value-added is taxed at full ordinary rates, which rewards deferring harvest on the best land and pushes cutting pressure to the margin. The essay explicitly proposes a synthesis rather than a single doctrine: "Concept A" (conserve for the future) and "Concept B" (use land now, intensively) are not opposites but apply to different places — "use the good lands intensively... thus relieve human pressure and help conserve the vulnerable, erosive lands." This is a distinct, land-value-tax-specific delta on the forestry page's ground: the earlier A3 piece surveys tax bases in the abstract; this essay adds the runoff/erosion consequence of getting the choice wrong.
Urban Sprawl
The essay makes explicit an argument only implicit in research/gaffney-containment-policies-urban-sprawl (1964) and research/gaffney-synergistic-city (1978): that sprawl is not just wasteful of land, capital, and fuel but is itself the mechanism of nonpoint pollution. Gaffney lists roughly a dozen ways sprawl "maximizes or worsens" runoff and related harms — more car-miles and smog per unit of urban linkage; more paved area and roadside salt; grading and denuding of new (typically upstream, sloping) land; more septic tanks in place of sewers; larger lots, longer driveways; and the filling of wetlands that would otherwise filter runoff before it reaches shellfish beds and estuaries. He cites a concrete figure: developing urban areas cover only 2.6% of the Menominee River watershed in Wisconsin but contribute 37% of suspended solids and 48% of phosphorous loading (Bauman et al. 1980, cited via Falk 1985). His illustrative case is Milwaukee, which lost 20% of its population after 1960 even as its suburban counties grew and its own core decayed — "a fourth of Milwaukee should be renewed forthwith, obviating much of the random lateral expansion onto new land upstream of it," a compact-city argument for pollution control rather than aesthetics or transit efficiency, citing his own 1970 work.[1] The essay closes on Milwaukee's Depression-era socialist mayor Daniel Hoan as a model of civic will: "Dan Hoan had fun making Milwaukee work; he is as good a model as we need."
Agriculture
The essay's briefest domain (the case is truncated relative to forestry and urban sprawl in the surviving text) restates the same displacement logic for farmland: tillage-versus-grazing debates and site-specific erosion controls matter less than whether cultivation pressure concentrates on good land or spills onto fragile land — "'where' and 'when' are as [important as technique]... the proper watchword."
Standing and Limits
- A Gaffney-authored policy essay in a lower-profile venue, not a peer-reviewed empirical study. The essay's factual claims (the pesticide windfall-compensation pattern, the Milwaukee CBD figures, the Menominee River loading data) are drawn from secondary sources Gaffney cites but this wiki has not independently verified; treat the argument as Gaffney's own synthesis (C/D-claim) rather than as newly established fact.
- The seven surrogate-tax failure modes are argued, not modeled. No formal welfare-loss calculation is offered for any of the seven; they are worked examples and citations to others' findings (Hall & Norgaard 1973; Lipsey & Lancaster 1956–57 for the second-best point), not a Gaffney original econometric contribution.
- The venue could not be fully verified. Only the abbreviation "JBA" and "Vol. 18, No. 1 and 2, 1988/89" appear in the scanned document; the full journal title is unconfirmed (
[VERIFY]). - The land-value-tax solution is asserted, not tested against nonpoint pollution outcomes specifically. No study cited in the essay (or found independently for this page) measures runoff or water-quality outcomes under a land-value-tax regime versus a conventional property tax; the causal chain — LVT discourages sprawl and idle-land holding, which reduces grading/denuding, which reduces runoff — is Gaffney's inference from the LVT-anti-sprawl mechanism already documented (with its own caveats) on the containment-policies and synergistic-city pages, not an independent empirical result of this essay.
- F2Q, a related but distinct 1966 item, was read and declined a page this wave. "Welfare Economics and Environmental Quality" (Gaffney's comments on Allen Kneese at the 1966 Resources for the Future Forum on Quality of the Environment) is a witty discussant response, not an original research contribution — its one durable point, that "increments to land rent represent the benefits of pollution control in an area, net of the associated costs" (i.e., land-value capitalization as a measure of environmental-quality benefits), restates the same land-rent-as-benefit- measure logic already covered on this wiki via tax capitalization and Oates (1969), predating both by three years but adding no new mechanism beyond what those pages already establish.
